What is Process Service?
Process Service (also referred to as
Service of Process) is the act of delivering a summons, writ, or other legal
notice to the person required to respond to it.
What is a Process Server?
A process server specializes in
delivering (serving) court papers such as summonses, complaints, subpoenas, and
various other legal documents according to the jurisdictional rules of civil
procedure. These rules specify how court documents must be served. These rules
differ from state to state. You might think of a Process Server as a courier who
specializes in delivering legal documents. Process Servers generally only serve
legal documents pertaining to a civil action.
Why should I
have
The tradition of having theSheriff serve legal documents is a very old tradition. Stopping bad guys

and thats where most of the Sheriff's resources are dedicated. A Process Server's expertise

What do you base your fee on?
Service fees are based upon on
time, expenses, and the intense effort given to each case.
How will you get my papers?
If you are a local Plaintiff in
Clermont County Ohio, we will pick them up at any of the courthouses in
What should I send along with my papers?
Along with your papers, please send us your contact information,
any information you may have about the intended recipient that
may help in locating them, including current employer,a physical description or
even photo if you have one. This is especially helpful in domestic and
small claims cases when the person is trying to evade service, or when trying to
track a person who has moved. For service on a business or a person to whom
you are not familiar, this isn't necessary. Also send specific instructions as
to who, where and how the papers are to be served, and a last day to attempt
service (ask your attorney or the court clerk for assistance with this) and a
check for the quoted amount made out to Hamilton Field Services LLC.
What if the address I provide for the respondent is incorrect?
If the address you provide us is
incorrect, we will attempt to obtain a good address in the immediate vicinity.
WE DO NOT guarantee the results of this Level 1 Skip Trace, but we will perform
it as a courtesy in order to get your papers served and secure your future
business. If we can verify an address in the immediate vicinity we will gladly
attempt service at that address. The decision to perform this trace and attempt
service at another address at no charge is AT OUR DISCRETION ONLY. If the address you
provided is incorrect we still collect our fee due to the time, effort, and expense we
have invested in your case. If another address is located but is not in the
vicinity, additional charges for service will apply if you decide to have us
serve your documents there.
How will I know when my papers have been served (or haven't been served)?
We will call you. You will also be updated if there will be a delay in service (recipient is on vacation etc.), or if we can't serve the papers (i.e. incorrect address).
What happens if my papers aren't served in
three attempts?
Hamilton Field Services LLC guarantees three diligent attempts at serving your papers if the address is good. If the papers cannot be served in three attempts we will inform you of the circumstances and you can decide if you wish us to continue serve attempts at additional charge or if you would like us to return your papers along with an affidavit stating the circumstances. We may provide more than three attempts with no additional charges at our discretion only.
What will you send me after the papers are
served?
After completing the service of your documents we will send you a notarized affidavit
(also called a Return of Service) stating when and where service was made, how
the papers were served, and to whom the papers were served upon and
any other information required to be sworn to by the Rules of Civil Procedure. If service
was not effected, we will send you a notarized affidavit indicating the places,
times, and dates of attempted service and why service was not made for each
attempt. We do not charge extra for affidavits or Notary service. If you are a
